Your help on the matter is appreciated. I am EB3-I. I filed for I-485 in July-07. I have been working on H1. Now I am going to switch to EAD by AC21. My new job has same job title and job duties. They have another condition for job. I will have to have a Masters in 8 years of starting my job.Their basic requirement is still Bachelors but Masters condition is kind of extra condition. My question is does this give me any trouble for my GC process because of Masters condition.Another question is will I be able to switch to EB2 based on this.

my current situation is like this.
i have H1B with Company A and it is valid till next year but i moved to Company B past two years back i worked with them now no job he said he is terminating h1b, so can i stay with previous company A (once i get the job i can switch to him until then can i stay with there h1b or not) or i will be in illegal status plase help me out.:confused:
and what actually be the Termination process of h1b

Hi,
I am here in US working for a company on L1 Visa. My Visa and I-94 expires on November 2010. The company has already applied for my H1. I am planning for a vacation to India in August. I have the following question,
1. When I comes back to US from my vacation, in September, I dont have to go to the consulate, as my L1 is still valid. And I wont be able to go to the consulate for H1 stamping, as they wouldnt have started the stamping for this year, right?
2. Once I am back in L1, do I have to go back to India for H1 stamping, as my L1 expires in November?
3. Or the best method is to visit India after October and get it stamped with H1 from the consulate while coming back from India?

My paper filed EAD ( and for my wife as well) has been pending since June 20th.
We called USCIS yesterday separately and both times they insisted that we needed biometrics and created SR for that.
Any one else had similar experience.?
Also I was trying to search for the Thread that has suggestions / steps to take to expedite the EAD. I think I'd qualify for severe financial hardhip since both of us will have to stop working if EaD doesnt come by October 18th.
Can some one point to that thread.

We are among the July filers. TSC applications went to VSC and back to TSC. My wife and I both got our EADs. Social Sceurity office told my wife that her A# is bringing up someone else's data. We went to Infopass, but it was of no help and we were adviced to contact or write to TSC. We placed a service request by calling the national phone number. That was more than two weeks back. Nothing has happened yet. All three applications - 485, EAD, AP has the same wrong A#. Her EAD is of no value without the correct A# that has to be rectified at the 485 stage and then EAD. Any suggestions?

Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

I just got off infopass appt. after talking to someone in USCIS serv center.
was told that the case is in the examination section. He did not give me any details as he said thats all what he sees on the screen.
any one tell me what that means and how long could it before they will adjudicate?

As the title says, can I change from AOS to CP even though my PD is not current.
Will the consulate process my case even if the PD is not current ?
I guess, they should depending on the number of applications at the consulate.
Please let me know whether I should take this route.
Well my PD is Feb 2007 (EB2) so I was thinking of this route rather than wait for endless years in this mess :(
