Hi,
Got an RFE for my wife to complete the required vaccinations. She did not take 2 required vaccinations when we filed I-485 as we were expecting a baby. USCIS along with the RFE sent the original I-693 form that had been submitted and asked us to present this form to the same surgeon to complete the medical.
Question:
At this point, I believe that USCIS does not have the medical record (I-693) as they returned it to us. Will the surgeon have to give a new I-693 consolidating the new 2 tests + the tests taken earlier? This case we will send a new I-693 comprising of all tests taken to date.
OR
Specify only the 2 tests that are done now and we send to USCIS the returned OLD copy + new COPY with the 2 tests?

Dear attorneys, I have a situation and will appreciate your response on it.
My PERM was recently approved and my company is getting ready to file the I-140. My attorney just noticed that my company at the time of registering the PERM account accidentally listed the FEIN number of their sister company (with similar name) rather than the FEIN number of the company that filed my PERM and on whose payroll I am for the last three years.
Do you think this would be a problem at the I-140 stage since the FEIN number on the PERM is different from the one on the Form I-140 and my paystubs/ W-2? My attorney is telling me that this should not be a problem as it is a typo and he can explain this to the US CIS at the time of filing the I-140 or maybe we can stay quite about it now and will explain it to the US CIS if they have any questions about it.
I will appreciate your response to this.

My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).
I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...
Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

Hi All,
I am planning to work for own incorporation on EAD , My PD is 2006-05 EB3 India . I don't see my 485 getting approved in next couple of years so wanted to work as consultant. Gurus can you please advice if it will have problems with 485 approval.

I have noticed that they have been given instructions not to give any information now due to the volume of calls HOWEVER if you keep trying you might get one person who is kind enough to answer your questions..
I tried 3 times (called with few days in between) and two time I faced pretty short replies with no help. But third time I got a very nice person who gave me more info. Among the few things I learnt were that they are still doing cases as of Aug 2006 and few random cases are being worked on dates after that. Details about I-140 will not be told unless you are the employer or the attorney. But you can ask about the status of your name check.

Such an action would be illegal, but CIS has already stopped accepting I- 485 applications for another category known as "Other Workers," despite June Visa Bulletin showing that category is current. My advice to all of you is keep filing all through the month of July. For all we know, they may never issue such an illegal policy or they might lose a lawsuit filed against them. So keep filing.

You can file I-485 only when your PD is current. There is no connection between filing for I-485 and I-140 approval.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?
